Personal Data Protection (GDPR)
Privacy Policy
Mgr. Pavel Schreiber, attorney, registered in the list of attorneys kept by the Czech Bar Association under reg. no. 17820, ID: 06489508, with registered office at Koráb 1125, Vizovice, tel. 731 029 857, e-mail: [email protected], (hereinafter "Attorney") is the controller of personal data of his clients and, where applicable, other natural persons whose personal data are provided to him in connection with the provision of legal services (hereinafter "Data Subjects").
The processing of personal data is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter "GDPR"), Act No. 110/2019 Coll. on personal data processing, Act No. 85/1996 Coll. on the legal profession, professional regulations issued by the Czech Bar Association and Act No. 253/2008 Coll. on certain measures against money laundering and terrorist financing (hereinafter "AML Act").
Legal Basis for Processing Personal Data
The legal basis for processing personal data of Data Subjects is:
- performance of a contract pursuant to Article 6(1)(b) GDPR (processing of personal data based on a legal services agreement concluded with the client),
- compliance with legal obligations pursuant to Article 6(1)(c) GDPR (obligations of the attorney arising from relevant legislation, in particular the Act on the Legal Profession and the Act on certain measures against money laundering and terrorist financing), and
- legitimate interest of the attorney pursuant to Article 6(1)(f) GDPR (enforcement of the attorney's rights under legal services agreements)
Categories of Personal Data Processed
- identification and contact data (name, surname, title, birth number, date of birth, residential address, phone number, e-mail);
- payment data (bank account number);
- personal data related to court and administrative proceedings and ensuring defense in criminal proceedings;
- other data necessary for the proper provision of legal services and fulfillment of legal obligations;
Recipients of Personal Data
Personal data are transferred to collaborating attorneys of the Attorney, employees of the Attorney, collaborating persons of the Attorney (accounting services, IT services, etc.) and, where applicable, to other entities for the purpose of providing legal assistance to clients. Personal data are transferred only in justified cases according to the purpose of their processing, in accordance with the law (e.g. according to the AML Act) and to the necessary extent.
Personal data are not transferred to third countries.
Personal Data Retention Period
Personal data are stored only for the period necessary and according to the purpose of their processing. Depending on the purpose and reason for processing, the following processing periods apply:
- performance of contract - for the duration of the contract and subsequently according to archiving and shredding deadlines for max. 5 years,
- fulfillment of legal obligations - in accordance with the relevant legal regulation, which also determines the period for processing and storing personal data by the Attorney,
- legitimate interest of the Attorney or his client - for the period necessary to protect the legitimate interest of the Attorney or his client, and subsequently according to archiving and shredding deadlines for at least 5 years,
Rights of Data Subjects
Data Subjects have the right to request from the Attorney:
- access to processed personal data,
- exercise the right to data portability, rectification and erasure, restriction of processing
- object to processing if they believe that the processing is not lawful, or they may also file a complaint with the Office for Personal Data Protection, Pplk. Sochora 27, 170 00 Prague 7,
