Privacy Policy
Mr. Pavel Schreiber, lawyer, registered in the list of lawyers maintained by the Czech Bar Association under ref. no. 17820, ID: 06489508 with registered office at Koráb 1125, Vizovice, tel. 731 029 857, email: office@akaschreiber.cz, (hereinafter referred to as "Lawyer") is the controller of personal data of his clients and, as the case may be, other natural persons whose personal data have been provided to him in connection with the provision of legal services (hereinafter referred to as "Data Subjects").
Processing of personal data takes place in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter 'GDPR'), Act No. 110/2019 Coll. on the processing of personal data, Act No. 85/1996 Coll. on advocacy, professional regulations issued by the Czech Bar Association and Act No. 253/2008 Coll. on certain measures against the legitimization of proceeds from criminal activities and the financing of terrorism (hereinafter 'AML law').
Legal basis for processing personal data Data subjects are:
performance of a contract pursuant to Article 6(1)(b) of the GDPR (processing of personal data based on a contract for the provision of legal services concluded with the client),
fulfillment of legal obligations pursuant to Article 6(1)(c) of the GDPR (obligations of a lawyer arising from the relevant legislation, in particular the Act on Advocacy and certain measures to combat money laundering and the financing of terrorism) and
legitimate interest of a lawyer pursuant to Article 6(1)(f) of the GDPR (enforcement of the lawyer's rights under contracts for the provision of legal services)
Categories of processed personal data:
identification and contact details (name, surname, title, birth number, date of birth, address, phone number, email);
payment details (bank account number);
personal data related to conducting judicial and administrative proceedings and ensuring defense in criminal proceedings;
any other data necessary for the proper provision of legal services and compliance with legal obligations;
Personal data subjects
Personal data is transferred to cooperating lawyers of the Lawyer, employees of the Lawyer, cooperating persons of the Lawyer (accounting services, IT services, etc.) and possibly other entities for the purpose of providing legal assistance to clients. Personal data is transferred only in justified cases according to the purpose of their processing, in accordance with the law (e.g. according to AML law) and to the necessary extent.
Personal data is not transferred to third countries.
Personal data retention period
Personal data is stored only for the time necessary and for the purpose of their processing. For the purpose and reason for processing, it is the following processing time of personal data:
contract performance - for the duration of the contract and subsequently according to the archival and shredding deadlines max. 5 years.,
fulfillment of legal obligations - in accordance with the relevant legal regulation, which also determines the processing and storage period of personal data by the Lawyer,
legitimate interest of the Lawyer or his client - for the time necessary to protect the legitimate interest of the Lawyer or his client, and subsequently according to archival and shredding deadlines for a period of at least 5 years,
Data Subject Rights
Data subjects have the right to consult the Lawyer:
request access to processed personal data,
exercise the right to data portability, correction and deletion, restriction of processing of personal data
object to processing, if they believe that the processing is not lawful, and have the right to lodge a complaint with the Office for Personal Data Protection with its registered office at Pplk. Sochora 27, 170 00 Prague 7, www.uoou.cz.
